FATHER TO HANG FOR KILLING SON

The High Court in Arusha has sentenced to death a resident of Kwa Mrombo area in the city, Amedeus Mfoi, for deliberately killing his son, Amani Amedeus Mfoi, more than a year ago.

Delivering judgement, Judge Silvester Kainda said the discovery of the body, established a clear and compelling case for the charge of murder, the Judge added.

The prosecution had alleged that on or about January 23, 2024, at Morombo-FFU within Arusha City, the accused unlawfully killed his son whose age was not immediately known.

The prosecution had proved its case beyond doubt through the evidence of six witnesses and seven exhibits tendered in court.

‘As a whole then and for the analysis and reasons advanced above, I hereby find the accused Amedeus guilty of the offence of murder of Amani contrary to Section 196 and 197 of the Penal Code, as charged. He is hereby convicted accordingly,’ he declared.

He pointed out that having convicted the accused of murder and considering that there was no aggravated and mitigating factor, his hands were tied since there was only one known penalty for the offence of murder. He had no option, he said, other than to pronounce the prescribed sentence.

‘Pursuant to section 197 of the Penal Code, the offence of murder carries a mandatory sentence of death. Accordingly, I sentence the accused, Amedeus, to suffer death by hanging. It is so ordered,’ the judge declared as he passed the sentence.

The confession of the accused supported by forensic evidence and the circumstances surrounding the discovery of the body, cemented the prosecution’s case.
