You know that friend who says, “Don’t worry, just put the company in my name”? Well, the law may soon have a few questions for both of you!
Tanzania is proposing new requirement aimed at strengthening transparency around beneficial ownership. The idea is simple: The person whose name appears on company documents may not always be the person who ultimately owns, controls or benefits from the company.
For example, John may appear as the shareholder, while actually holding the shares for Mary. Under the proposed changes, arrangements involving nominee shareholders and directors could receive greater legal attention.
These proposed requirements are intended to make it easier to identify the real individuals behind companies and strengthen efforts against financial crimes and hidden ownership.
So, before saying, “It’s not my company; my name is nowhere on it,” remember: The law is becoming increasingly interested in who is really behind the curtain!
