Someone has breached a contract and owes you money. Naturally, you are angry. But please, do not become the court, judge and bailiff all at once!
Under Tanzania’s Law of Contract Act, a breach of contract gives the affected party legal remedies. Section 73 provides for compensation for certain losses caused by the breach. But this does not mean you can simply take, keep or interfere with another person’s property because they owe you money.
First, check the contract. Does it give you the right to suspend services, terminate the agreement or retain certain property? If yes, follow the agreed terms. If not, use lawful ways to recover what you are owed.
The simple rule is: A breach gives you a remedy not a licence to do whatever you want.
Sometimes, in trying to recover your money, you may end up creating another legal problem for yourself!
