THE High Court at Tanga has ordered Halima Togolai Gidioni be released from remand prison where she was detained over a manslaughter charge for ‘killing’ her lover, Christopher Charles, of Majani Mapana area in Korogwe district, early this year.
Judge Abdallah Gonzi ordered her released despite pleading guilty as charged. The Judge held that the facts presented by the prosecution could not establish the offence.
“In that regard, the accused person is hereby acquitted of the charge of manslaughter. Since the accused is being held in remand custody in prison, I direct that the accused shall forthwith be released therefrom unless otherwise lawfully held therein,” the judge declared in a judgement delivered recently.
The accused allegedly stubbed the deceased on his chest while attempting to free herself from forceful sodomy after the duo failed to agree on engaging in an act of unnatural sex during love making.
The judge said that if what the accused did was to be termed as an “unlawful act”, it would amount to telling her that she should have been gentle and let the deceased forcefully sodomise her.
It was alleged that the incident occurred on March 5, 2026 at Majani Mapana area in Hale Ward, within Korogwe District in Tanga Region. Prior to the killing, the duo, who knew each other, had gone to Mama Pati Restaurant for lunch.
While there, they ate food and started drinking local alcohol. They remained at the said restaurant until night hours. Upon becoming heavily drunk, the duo went to the deceased’s house at Majani Mapana to sleep.
When they wanted to have sex, the accused person told the deceased that she was in her monthly period, but the deceased insisted that they do it against the order of nature.
